Hello,

My artist name is Kei (pronounced as KEY) and I draw as a hobby. I'm currently new to the Twitch and Artist Alley community.

As a self-taught artist, I am currently trying to broaden my skills which explains my inconsistent art style through pieces.

Luckily, I've been given an Artist Alley tabling experience and many chances to improve through my commissioners.

TERMS OF SERVICES


Please read this before ordering to avoid problems!

By ordering any commission, you agree to the terms of services. Exceptions will be made when discussed with ME, the artist, prior to the commission.

Please ask me about anything that you are unsure or not have a clear understanding to help avoid problems and confusion, as well as misunderstanding and false accusations.

[I] General Terms


Please write in a clear and nice mannered to the best of your ability.
Clear image references are always preferred than text references.
Please try to avoid walls of text. If you have a deadline that needs to be met, please let me know beforehand to confirm if I can meet it.

Any ill behavior will not be tolerated, and your commission will be cancelled. If poor behavior is seen during commission after the payment, the payment will not be refunded.

Failure to follow the criteria listed above, and/or I feel uncomfortable with the commission, I have the right to decline your commission.
The reason will be given for declining.

If you wish to obtain copyright to the commission, please identify at the start of the commission and a contract will be made to satisfy BOTH the commissioner and artist.

[II] Payments


All commissions must be paid once agreed on sketch through PAYPAL! The currency accepted is USD.

You will receive a PAYPAL invoice to the email you provided to me and have until 1 week from the date to be paid. If it is not paid, your commission will be retracted and will not go further until you recontact me.

If any complications occur and you cannot pay by 1 week, it is your responsibility to contact me and talk to me so we can pick a more suitable date for you.

Fee Charges: Any orders that are rushed will have an additional fee to the commission. You can find additional fees and rushed fees listed here.

[III] Process


I work based on a first come first serve basis generally, but I may work on multiple projects at once. I will not be progressing on the commission until the payment is received. Work in Process (WIPS) will always be offered to all commissions unless declined otherwise.

An estimation of how long your commission will take to be completed will be given to you. The estimation will be based on how complex it is and your placement on the “To-do list”.

Clarifications on certain areas such as colors or positioning will NOT count towards a WIP!

Please be aware that communication is key to commissions to being done to your vision and I will be providing updates as much as I can. You are free to ask about updates and remind me when in doubt, but please do not spam me for updates and ask reasonably.

There is a slight chance that I will stream the process on Twitch. If you wish for me to work in private, please let me know. References given that includes ANY IRL references such as photos of you or whoever you are commissioning for will not be shown on stream.

*Note: If you see anything wrong or do not like how something is and don’t say anything until the completion date, your commission completion time will be pushed further and the payment will be raised.

[IV] Customer Satisfaction


I will do anything and everything I can in order to make my customers satisfied as long as it's reasonable. I'm human, we all make mistakes.

Finished products cannot be fixed, aside from minor mistakes and changes.
E.g. color fixes and small marks

Bigger changes that will make me redraw any part, will be charged extra, depending on how much is being changed unless it was my mistake from misinterpreting something simple. However, I will always try to make ideas clear before starting the commission.

Please tell me of any changes as soon as possible to make it an easier process.

[V] Cancelling/Refunds


I hold the right to cancel and refund the money for the commission at anytime. This may be due to personal reasons that makes me believe that I cannot complete the commission or it has made me uncomfortable. I will give the option to choose between a refund or a longer wait time.

The commissioner will be allowed to ask for a refund if the commission was not worked on for a month since the last update. Other situations will need to be agreed upon by both the artist and commissioner.

If you file a charge back, I will retract everything you have ever received from me and I will have full rights to do ANYTHING with them.
You will be blacklisted and forbidden to order from me ever again.
I will call you out, spread your name to the public and all the social media I have for others to watch out for.
I also have every right to file a complaint and keep the money for myself.

[VI] Copyright


I retain all copyright to art.
I will have rights to:

  • Post/publish it anywhere to my liking.

  • Use it to promote myself.

  • Display it wherever I wish.

  • Use it in books or zines as examples and to showcase my work.

  • I will not resell the work or put it on merch to sell to others.

  • (with the exception of above)

Commercial use means to use with the purpose of gaining a profit such as reselling, printing on merch etc.

The commissioner may repost and use the commission piece, but you must not make edits (without permission), and credit MUST be given.

The Commissioner is allowed to:

  • Use the copyright artwork for personal use only unless agreed otherwise

  • Print the art, for NON-COMMERCIAL use and claim the right of their character(s), but not the drawing itself.

  • Use the art to promote themselves with proper credit given to the artist

  • Edit to use for banners, overlays, etc.

The following is restricted and considered copyright infringement unless agreed/given permission otherwise:

  • Use for commercial purposes.

  • Taking credit for the creation of the work.

  • Removing the watermark/signature on the work.

  • Editing/altering the work.

  • Not giving full credit when reposting.

Any sort of infringement will cause your commissioned piece to be retracted from any rights of use.

By commissioning me, you agree to all terms of service.
